Articles of civic association judges "For open judiciary"









Article 1


The civic association named Judges “For Open Judiciary“ (abbreviated “ZOJ“) is the organisation of judges of the Slovak Republic established in accordance with provisions of § 1 of the Act 83/1990 Coll. on citizens association as amended.

ZOJ is a legal entity.


Article  2


The domicile of ZOJ is Bratislava, Olivova 38, 831 01 Bratislava – Nove Mesto.


Article  3


ZOJ has no political ambitions and ZOJ is not connected to any political party.

The main goals connected with all positive activities and efforts of judges of the Slovak Republic that after 1989 resulted in separation of judiciary as one part of the state power are:

-          to carry through a model of judiciary with its main attributes openness and transparency for citizens, as the source of power in a democratic country with rule of law,

-          to actively and initiatively protect independence of judicial power against external and also internal impacts,

-          to strengthen responsibility of judges for performance of their judicial power.


With the purpose to meet these goals ZOJ will cooperate also with other judicial and civic associations at domestic and international levels.


Article  4


(1)A judge who identifies him/herself with these goals and these Articles of Association and who confirms this in his/her membership application can become a ZOJ member.

(2) Membership is voluntary. Membership starts by delivered written membership application to the seat of ZOJ confirmed by ZOJ Presidium.

(3) Any person who significantly helped to meet ZOJ goals may become an honorary member of ZOJ. A members Conference grants the status of an honorary member upon motion of the Presidium.


Article  5


(1) Membership in ZOJ terminates

a/ when a member delivers a written notice on his/her termination to the ZOJ address,

b/ when a member is excluded,

c/ when a judicial position terminates, except of a retirement of a judge,

d/ by death,

e/ when ZOJ is dissolved.

(2) The Presidium shall inform the member in written that his/her membership was terminated according to paragraph 1 letters b/ and c/.

(3)A member may be excluded from ZOJ for his/her behaviour that was contrary with the goals of ZOJ, and for a repeated or an especially significant breach of basic obligations of a member. The members Conference decides upon exclusion of a member.

 (4) Status of an honorary member of ZOJ terminates on the day of a decision of the members´ Conference on his/her removal upon motion of the Presidium.


Article  6


(1) ZOJ member is entitled

a/ to participate in activities of ZOJ, mainly to submit motions, requests, comments and to participate in the members Conference,

b/ to elect and to be elected to ZOJ bodies,

c/ to be informed on position of respective body of ZOJ on his/her proposal, position, comment or request.

(2) A member is obliged

a/ to act and to behave in accordance with the goals defined in Article 3 thereof,

b/ to respect the Articles of Association and decisions of ZOJ bodies,

c/ to pay membership fees in time and properly.


Article  7


(1)The members Conference is the supreme body of ZOJ.

(2) Elected bodies of ZOJ are

a/ the President,

b/ the Vice President,

c/ the Presidium,

d/ the Inspector.

(3)The Consulting Board is the advisory body of ZOJ.

(4)Executive bodies of ZOJ are bodies defined in paragraph 2 letters a/ – c/ of this Article.

(5) Membership in elected bodies of ZOJ is opposing to membership in any other judicial organisation; membership in body defined in paragraph 2 d/ of this Article is also opposing to membership in an executive body of ZOJ.

(6) Bodies defined in paragraphs 2 and 3 are elected for a period of three years. The same position can be held consequently twice maximum.


Article  8


(1) A members Conference is convoked by the Presidium at least once a year. A members Conference comprises of the present members of ZOJ, who may also represent absent members upon their authorisation. Details will be defined in the Meetings Rules.

(2) An extraordinary Conference of members must be convoked if asked for by at least one fourth of all ZOJ members. A request for an extraordinary Conference must include a draft programme for the Conference. In such case a Conference is convoked and also held within one month from delivery of such request to the seat of ZOJ at the latest; draft programme after a Conference is convoked cannot be modified.

(3)A members Conference negotiates and decides on the following

a/ ZOJ dissolution,

b/ Articles of Association modification,

c/ Report on ZOJ activity,

d/ management and activities of the Inspection Committee (Inspector) and

e/ amount of member fee.


(4) A members Conference also

a/ elects and recalls bodies defined in Article 7 paragraphs 2 and 3 thereof,

b/ grants and removes the status of an honorary member of ZOJ,

c/ approves internal organisation rules of ZOJ.


Article  9


(1) The Presidium is the supreme executive body of  ZOJ. The Presidium acts and decides in the name of ZOJ in time between the members Conferences. The Presidium is responsible to the members Conference.

(2)The members of the Presidium are the President, Vice President and three other members.

(3)A members Conference decides any appeal against a decision of the Presidium. Details will be defined in the Meetings Rules.


Article  10


(1) The President represents ZOJ outwards. He/she is authorised to perform in the name of ZOJ any legal action upon consent of the other Presidium members he/she has to ask for except of a case that cannot be delayed.

(2)The President convokes the Presidium meetings as needed. He/she always convokes a meeting without any delay if asked by at least two Presidium members. He/she also drafts a meeting programme.

(3) The President secures also information to public on activities of ZOJ through a web page.


Article  11


(1) The Vice President fulfils tasks given to him/her by the President or by the Presidium.

(2) He/she represents the President fully in time when the President cannot perform his/her position.


Article  12


(1) The Inspector carries out control of ZOJ management. He/she carries out his/her activities independently from any other elected bodies of ZOJ, however, he/she is obliged to carry out control of management if asked for by the Presidium.

(2) The Inspector presents an Annual Report on ZOJ management to a members Conference.



Article  13


The Consulting Board helps to fulfil goals of ZOJ, mainly it provides and communicates to the judiciary any opinions and views of civic public on problems in judiciary and ideas how to solve such problems.

The Consultation Board consists of at least 5 members, who are elected from personalities from cultural, academic, public environment and civic society environment.


Article  1 4


A position in ZOJ body terminates:


a/ by termination of a position period,

b/ by resignation to the position,

c/ by removal made by a body that elected such member,

d/ on a day when a membership of a member starts in another organisation of judges,

e/ by termination of ZOJ membership.


Article  15


ZOJ financially secures its activities from membership fees and other fees of ZOJ members and from the means acquired in projects that serve to meet ZOJ goals.



Article  16



ZOJ terminates by

a/ voluntary dissolution,

b/ other reason defined by law.



Article  17


(1)Details on elections, meetings of ZOJ bodies, organisation structure of ZOJ and financing will be defined in internal organisation regulations.

(2) The Preparatory Committee fulfils the roles of the ZOJ elected bodies before these are determined as defined in Article 8 paragraph 4 a/ thereof.

(3) These Articles of Association come into effect on the day of ZOJ registration.
